Chilima Still Waiting for ICC's Action

Vice President Dr Saulos Chilima and his legal team say are still waiting for further communication from the International Criminal Court Legal on their application in which they are suing former President Peter Mutharika and the former Police Inspector General Duncan Mwapasa for alleged crimes against humanity conducted between 2018 and 2020.

Despite acknowledging receipt of the complaint Zodiak understands the International Criminal Court has yet to inform the vice president on the way forward.

In his report, Dr Chilima cites the crimes as murder under Article 7(1) (a), rape and other forms of sexual violence under Article 7(1),  causing severe injury under Article 7(1) (k) and persecution based on political affiliation under Article 7 (1) (h) of the Rome Statute.

Among the issues cited in the report are the petrol-bombing of the UTM party offices in area 24 in Lilongwe and the raping of women and girls in Nsundwe, Mbwatalika and Mpingu in Lilongwe by suspected police officers.

The report also urges the court to investigate several other offences that took place during the past regimen but were left hanging by the police.

According to Dr Chikosa Silungwe who was representing Dr Chilima in this case, the vice president made the application in his personal capacity on 11 June 2020.

While stating that the ICC usually takes time to look into individually made applications, Dr Silungwe however says the court acknowledged receipt of the application and assured that it will start looking into it soon.

A prosecutor at the ICCs is expected to analyze and investigate the information given in line with the Roman Statute that establishes the court.

Meanwhile, the new TONSE administration seems to be making follow-ups on some offences made in the past regime and some suspects have been arrested.
