In his application, Sumbuleta argued that continuing the case in Lilongwe puts a severe strain on his financial resources.

A lead defense lawyer, David Kanyenda said any accused person is at liberty to be tried at a forum close to where he was arrested.

“We remain convinced that the independent judiciary of Malawi will deliver justice, we have seen justice and we expect justice to prevail in this case,” said Kanyenda.

Passing judgment, Kapindu said transferring the case from Blantyre to Lilongwe was contrary to clear legal principles.

The former director, Aubrey Sumbuleta previously pleaded not guilty on all seven counts related to abuse of office and indecent assault.
