Two Courts Hear One Case in Thyolo and Chiradzulu

It has emerged that two magistrates' courts have been hearing one civil case involving land wrangle separately in Thyolo and Chiradzulu districts.

According to records at Second Grade Magistrate’s Court in Thyolo, the case dates back to 2017 when Jonathan Mpuluma sold family land.

Other family members took the matter to the magistrate’s court in Thyolo where judgment favored the complainants.

Mpuluma later appealed against the ruling to the High Court in Blantyre.

Before the judgment review, Mpuluma took the same case to Third Grade Magistrate’s Court at Thuchira in Chiradzulu where he won the case.

Another family member, Wyson Danger, told Zodiak Online that the magistrate at Thuchira court has been issuing warrants of arrest to the losing side as the case still awaits determination by the high court.

“Mr. Mpuluma is our uncle and he sold the family land which we protested and sued him at a Magistrate’s Court in Thyolo. Surprisingly, he also sued us at Thuchira court in Chiradzulu and he lost the case at the court and appealed against the ruling,” said Danger.

While Third Grade Magistrate Christopher Baluwa of Thuchira court says he is not aware of any appeal against the earlier ruling, Second Grade Magistrate James Balakasi says Mpuluma appealed against his ruling to the High Court in Blantyre.

Meanwhile, Registrar of the High Court, Gladys Gondwe, says she is following up the matter.
