14 Years IHL for Defiling and Impregnating Stepdaughter

Prison will be home for Laybu Asimu, 28, for the coming 14 years after a Mangochi First Grade Magistrate’s Court on Wednesday March 31, 2021, slapped him for defiling and impregnating his 14-year-old stepdaughter.

The court through state prosecutor, Police Assistant Superintendent Davie Banda, was told that the convict started defiling the girl in May 2020.

According to Assistant Superintendent Banda, the convict for three times persuaded to sleep with the victim, but she rejected while also reminded him that she is his daughter.

But Banda narrated in the court that during one night in the same month, Asimu, sneaked into the victim's room and found her fast asleep, he undressed her, covered her mouth and threatened to stab her and her mother with the knife which he carried while defiling her if she reveals.

Prosecutor Banda added that this became a tendency for Asimu and the girl was defiled six times but the issue was only revealed in February 2021, when the victim's mother noticed some changes on the girl’s appearance.

He said, after seriously quizzed, the girl narrated the ordeal and also revealed to be pregnant for the stepfather. The matter was reported to Chilipa Police Unit where a medical form was issued and results from Chilipa Health Centre confirmed about the pregnancy.

Appearing in court, the accused pleaded not guilty to the charge and the state paraded five witnesses who proved the case beyond reasonable doubt.

In mitigation, Asimu asked for court's leniency saying that he is a breadwinner in his family, but Prosecutor Banda prayed for a stiffer sentence saying such cases are on the increase in the district which put girls' lives under threat.

Furthermore, Banda said as a parent, the convict was supposed to protect her and not the other way round.

Passing judgement, first grade Magistrate Roy Kakutu, found him guilty and handed him a 14-year jail sentence to deter other would-be offenders.

Laybu Asimu hails from Songa 1 village, Sub Traditional Authority Ntonda in Mangochi district.
