Magistrate Reverses His Own Controversial Judgment

The controversial Thuchira Magistrate in Chiradzulu who sentenced Mr. Champion Muleso to a 14-day jail term in land case that is before the high court has unconditionally released the convict.

Third Grade Magistrate Christopher Baluwa confirmed himself to have issued the release order and was tightlipped to explain reason for the release.

“Yes, I can confirm that I have released Mr. Muleso from prison before completing his sentence and this is due to some factors surrounding the case and that is all I can say,” said Magistrate Baluwa.

However, Zodiak understands orders from above forced the Magistrate to immediately issue the release order as his handling of the matter was questionable.

Mr. Muleso also confirmed to us about his release from Thyolo prison where he has spent five days.

“I am at home now at January, here in Thyolo but I paid K10, 000 for transport of the court clerk form Thuchira in Chiradzulu to Thyolo prison to process my release from prison, “said Muleso.

Registrar of the high court, Gladys Gondwe, says the case has been under investigation and she said she will be furnished with a report on the same next week.

The family land case in question was interestingly handled by two magistrates’ courts; Thuchira Third Grade Magistrate’s court in Chiradzulu and Thyolo Third Grade Magistrate Court.

In the case which dates back to 2017, one family member, Jonathan Mpuluma was accused of selling the family land and other family members took the matter case to Thyolo Magistrate’s court where the judgment favored the complainants.

But Mr. Mpuluma appealed against the ruling to the high court in Blantyre and before the judgment is reviewed, he took the same case to Thuchira Third Grade Magistrate Chiradzulo where the judgment was in his favor.

On 26th March, Third Grade Magistrate Christopher Baluwa of Thuchira Court sentenced the family member, Champion Muleso, to a 14-day jail term for contempt of court.
