A First Grade Magistrate’s Court in Monkey-bay on Thursday convicted and sentenced Betchamin John, 24, for stealing a motorcycle.

The court through police prosecutor, Sub inspector Mary Mbutuka, heard that on 8th August, 2022, around noon, John was at Mtakataka Turnoff trading center in the district where he hired a motorcycle belonging to Mr. Haswel Kalimbakatha to a certain place within the trading center.

However, Sub Inspector Mbutuka said, upon arrival at a place where he was going, John hooked the Kalimbakatha with a twine and poured pepper on his face and mouth, before dragging him to a nearby Bush.

“Later on, he robbed him of his motorcycle valued at K1,375,000 and the matter was reported to Monkey Bay Police where a search was conducted, leading to the arrest of John and recovery of the motorcycle,” she explained.

In court John pleaded not guilty which prompted the state to parade 4 witnesses who proved him beyond reasonable doubt and the court convicted him.

During mitigation, John pleaded for court's forgiveness since the motorcycle was found, but the state prayed for custodial sentence, saying cases of such nature are rampant in the area hence the need for harsh sentences.

First Grade Magistrate Mtunduwatha Mpasu, agreed with the state's submission and slapped the convict with 13 years’ imprisonment with hard labour.

Betchamin John, hails from Chembe Village, in the area of Traditional Authority Nankumba in the same district.
