MEC Appeals Rerun Order

The Malawi Electoral Commission, has filed an appeal in the Supreme Court challenging a high court ruling nullifying election results for Mangochi West Constituency. The high court ordered a rerun.

MEC's Director of Media and public relations, Sangwani Mwafulirwa, says MEC feels that the high court did not take into account some critical evidence and material facts that MEC presented in the case.

In December last year, the High Court in Blantyre nullified Mangochi West Constituency parliamentary election results.

In his ruling, Justice Silvester Kalembera ordered the Malawi Electoral Commission to hold a parliamentary election re-run in Mangochi West on the basis there were significant irregularities and inconsistencies that affected the choice of the people in the previous election.

“This court has found that the parliamentary elections in Mangochi West Constituency were not free, fair and credible due to irregularities and inconsistencies that affected the will of the people,” he said.

Now, the MEC appealed In the Supreme Court against judge Kalembera’s ruling and order.

“The Commission has found that the high court did not consider some evidence and material facts that MEC presented to the court,” Mwafulirwa said.

Meanwhile, Mwafulirwa says the Commission will still be meeting to set a date for by-elections in Lilongwe South Constituency and Liwawazi Ward in Balaka where there are vacancies.

The petitioner in the case, Simeon Harrison, challenged the declaration of the Democratic Progressive Party's Jeffrey Chiwondo as winner.
