UTM's Theu Boxes DPP Witness, Lawyer Chimkango

Witness number two, and the last, for President Peter Mutharika, Bob Chimkango, has begun testifying in the constitutional court currently hearing the presidential election case in Lilongwe.

Bright Theu, lawyer for UTM president Saulos Chilima, is cross-examining Chimkago ( a fellow lawyer) to build a case that the 2019 presidential were mismanaged hence call for a fresh poll.

President judge, Hilly Potani, has had to, at one point, remind Chimkango that he was in the court as a witness and not a lawyer hence has to follow the procedures as a witness.

This came when Chimkango was resisting lawyer Theu’s insistence for a responds on the number of calls that Chimkango had made to DPP monitors from polling stations on day of elections.

Earlier today, DPP Director of Elections Dr. Ben Phiri finished responding to re-examination questions in which DPP lawyers sought to provide him an opportunity to explain some of the information he gave to the court in cross-examination by MCP lawyer Modecai Msisha.

Among other things, Phiri told the court that some party monitors left the tally centres without signing sheets in excitement or anger for either thinking they were winning the election or losing respectively.

This, he told the court, is why roving monitors were expected to present themselves as recommended by the Malawi Electoral Commission-MEC.

The re-examination, which begun Monday, lasted for slightly over two hours.Cross-examination of Chimkango is expected to take this afternoon and Wednesday.
