AG to Move Appeal On CDF Ruling

Nyirenda; not satisfied with the constitutional court ruling

Attorney General Thabo Chakaka Nyirenda says he will move the Supreme Court of Appeal to seek an interpretation on the ruling by the Constitution Court in Lilongwe, which has barred legislators from taking part in the management of Constituency Development Funds (CDF) and water development funds.

Ministry of Justice Spokesperson, Frank Namangale has confirmed the development through a written response, saying the Attorney General is not satisfied with the outcome from the court hence the matter.

"The AG is not satisfied with the outcome in the Constitutional Court, and it is the whole reason he is taking the matter to the Supreme Court for further interpretation," said Namangale.

The Malawi Local Government Association (MALGA) Executive Director, Hadrod Mkandawire says they do not understand the decisions by the Attorney General as the ruling by the court was clear, adding their organization is ready to meet the AG at the court.

A practicing lawyer, Khumbo Soko says seeking clarification and appealing against a ruling is a constitutional right.

"The supreme court is there to give definitive decisions based on the law. There is a lot of merit to that decision by the AG, I'm not backing it though," said Soko.

It is not known when the AG will move the court on the matter.
