The High Court, Civil Division, has dismissed an application by Malawi Congress Party (MCP) member Madalitso Kazombo, who sought leave to commence judicial review proceedings against the Malawi Electoral Commission (MEC) in relation to the just-conducted elections in the Kasungu East constituency.
In her ruling, Justice Violet Palikena-Chipao said she had noted several irregularities in the application, including typographical errors and wrong citations, among others.
Chipao, however, granted the applicant liberty to refile a properly drafted application with notice to MEC.
"In this regard, the application cannot be granted. It is dismissed with liberty to refile a
properly drafted application and supporting documents if the Applicant so wishes," reads part of the ruling.
Lawyer for Kazombo, Oscar Taulo, while not disclosing details of the application, says it all surrounds the parliamentary seat in the constituency that Kazombo is contesting for and was quick to note that they are returning to the court today to file a new application.
"We understand that electoral matters are of limited space; we are racing against the time, and we will meet the time," said Taulo.
Malawians had cast their votes on 16 September to elect president, members of parliament and councillors.
